Garden Estate Gurugram Under Scanner: Illegal RWA, Unauthorized Structures, And Questions Over Influence

Illegal RWA Running the Society?

Serious questions are now being raised over the functioning of Garden Estate RWA in DLF Phase-3, Gurugram, after official documents accessed through RTI reportedly stated that the current governing body was not legally constituted under the Haryana Registration and Regulation of Societies Act, 2012.

According to documents issued by the Office of the District Registrar, Firms & Societies, Gurugram, the association allegedly failed to comply with mandatory statutory procedures related to elections, annual returns, and required approvals.

The report submitted before the State Registrar reportedly stated that:

* Election-related documents were incomplete.
* Mandatory forms were not attached.
* Election approvals were never properly obtained.
* Annual financial returns were allegedly not filed as required.
* The governing body could not be treated as legally constituted under the HRRS Act, 2012.

The matter became more serious when the District Registrar appointed an Administrator-cum-Returning Officer in January 2026 to take over the management and conduct fresh elections.

Stay Obtained, But Questions Continue

Sources claim that the current RWA management later obtained a stay order from the State Registrar in Chandigarh against the appointment of the Administrator.

However, during the proceedings, the State Registrar reportedly sought a detailed report from the District Registrar, Gurugram — and that report again allegedly maintained that the current RWA body was not legally valid.

This has now triggered bigger public questions:

If the governing body itself is under dispute, then who is currently controlling the society’s finances and administrative decisions?

Crores In Compensation Under Control Of Disputed Body?

One of the biggest concerns being raised is that the society has reportedly received compensation worth crores related to land matters, while control of those funds allegedly remains with the disputed governing body.

Questions are now being raised regarding:

* Who is auditing these funds?
* Is there independent oversight?
* How are financial decisions being taken if the body itself is allegedly illegal?

There are also allegations of financial mismanagement and lack of transparency in internal functioning.

Illegal Structures And Occupation Certificate Questions

Another major issue revolves around alleged illegal constructions inside the society.

Questions are now being asked over:

* Why illegal extra floors and structures were allegedly allowed inside the premises.
* Whether influential individuals connected with the management received protection.
* Why action has allegedly not been taken despite repeated concerns.

Critics also point toward the Occupation Certificate (OC) issue, questioning how additional structures were permitted if the society itself allegedly does not possess complete OC-related compliance.

“Why Different Rules For Powerful People?”

The controversy has also sparked a wider debate in Gurugram over selective enforcement.

Questions are also being raised over:

* Small roadside vendors and temporary shops being regularly removed by authorities in the name of illegal encroachment.
* While influential societies or connected individuals accused of violations allegedly continue without strict action.

This has led to growing public concern and allegations of double standards in enforcement.

Complaint System Under Question

Another major concern being highlighted is that complaints against the management allegedly never move forward effectively.

The questions that arise include:

* An independent investigation,
* A financial audit,
* Verification of construction approvals,
* And complete transparency regarding the legal status of the current governing body.

Bigger Questions For Authorities

The Garden Estate matter is now becoming larger than a society-level dispute. It raises broader questions for Gurugram authorities:

* Are influential RWAs operating above the law?
* Why are statutory violations allegedly ignored for years?
* Who is accountable if an allegedly illegal body controls crores in public-interest funds?
* And why has strict enforcement not been applied equally?
